STEP 1: Read and sign the RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT PLEASE READ CAREFULLY — THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR RIGHTS In consideration for being permitted to participate in classes, trainings, guided bicycle rides, cycling events, or route recommendations provided or organized by Erin Green Racing and Nutrition LLC, an Idaho limited liability company, I, the undersigned participant (or legal guardian if participant is under 18) agree to the following: 1.Acknowledgment. I acknowledge that bicycling and the Activities have inherent risks that could result in serious injury or death to myself or others. These risks include, but are not limited to, falling, colliding with vehicles or other cyclists, encountering road hazards such as potholes and cracks, crossing roadway improvements, such as railroad tracks, adverse weather conditions, encountering or being chased by animals, falling trees and branches, bicycle failures and malfunctions, and physical ailments or effects such as dehydration and overexertion. “Activities” includes, without limitation: classes, trainings, guided rides, route recommendations, cycling instruction or coaching, nutrition guidance, mechanical assistance, staging or meeting activities, travel to or from ride start/end locations, and any related preparation, warm-up, cool-down, or post-ride activities connected in any way with Erin Green Racing and Nutrition LLC. 2.Medical Declaration. I certify that I am physically fit and capable of safely participating in the Activities. I understand that it is my responsibility to: maintain my bicycle in safe working condition; wear an approved helmet and appropriate safety gear; and follow traffic laws and ride safely at all times. I authorize the Released Parties (defined below) to obtain emergency medical care for me if necessary and agree that I am responsible for any resulting costs. I further understand and agree that wearing a properly fitted, approved bicycle helmet at all times during participation in the Activities is an express condition of participation. I acknowledge that failure to wear such helmet increases the risk of serious injury or death and is undertaken solely at my own risk, and may result in denial or removal from participation. 3.Waiver and Release. I KNOWINGLY AND FREELY ASSUME ALL RISKS, BOTH KNOWN AND UNKNOWN, ARISING FROM MY PARTICIPATION IN THE ACTIVITIES AND ACCEPT FULL RESPONSIBILITY FOR MY PARTICIPATION. I AGREE TO COMPLY WITH ALL STATED AND CUSTOMARY TERMS AND CONDITIONS OF PARTICIPATION. IF I BECOME AWARE OF ANY SIGNIFICANT HAZARD DURING MY PARTICIPATION, I WILL IMMEDIATELY REMOVE MYSELF FROM THE ACTIVITIES AND NOTIFY ERIN GREEN RACING AND NUTRITION LLC. TO THE FULLEST EXTENT PERMITTED BY IDAHO LAW, I EXPRESSLY RELEASE THE RELEASED PARTIES FROM ANY AND ALL CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES THAT RELATE IN ANY WAY TO MY PARTICIPATION IN THE ACTIVITIES. THIS RELEASE APPLIES EVEN IF SUCH NEGLIGENCE CONTRIBUTES TO MY INJURY, DAMAGE, OR LOSS. NOTHING IN THIS AGREEMENT IS INTENDED TO RELEASE CLAIMS ARISING FROM GROSS NEGLIGENCE, RECKLESS CONDUCT, OR WILLFUL MISCONDUCT TO THE EXTENT SUCH CLAIMS CANNOT BE WAIVED UNDER IDAHO LAW. FOR MYSELF AND ON BEHALF OF MY HEIRS, ASSIGNS, PERSONAL REPRESENTATIVES, AND NEXT OF KIN, I FURTHER RELEASE AND HOLD HARMLESS THE RELEASED PARTIES FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, OR CAUSES OF ACTION FOR INJURY, DISABILITY, DEATH, OR LOSS OR DAMAGE TO PERSON OR PROPERTY ARISING OUT OF OR RELATED TO MY PARTICIPATION IN THE ACTIVITIES, WHETHER CAUSED BY NEGLIGENCE OR OTHERWISE, TO THE FULLEST EXTENT PERMITTED BY LAW. “Released Parties” includes Erin Green Racing and Nutrition LLC and its members, managers, officers, employees, volunteers, independent contractors, ride leaders, route planners, coaches, sponsors, advertisers, equipment providers, and any property owners, governmental entities, or public agencies whose property, facilities, or roadways may be used in connection with the Activities. 4.No Medical Supervision; Participant Responsibility. I understand that the Activities are not medically supervised and that Erin Green Racing and Nutrition LLC does not provide medical monitoring. I am solely responsible for my physical condition, hydration, equipment maintenance, and decision-making during participation. I acknowledge that I must independently assess my ability to safely participate at all times. 5.Participant-Based Indemnification. I agree to indemnify and hold harmless the Released Parties from any claims brought by third parties arising from: my conduct during the Activities; my failure to follow safety instructions or applicable traffic laws; or the condition, use, or failure of my bicycle or personal equipment. 6.Photo and Media Release. I grant Erin Green Racing and Nutrition LLC the right to use photos, video, or other media of me participating in the Activities for promotional or commercial purposes. 7.Minor Participation; Parent/Guardian Indemnity. If the participant is under 18, the undersigned parent or legal guardian agrees to indemnify and hold harmless the Released Parties from any claims brought on behalf of the minor arising from participation in the Activities. 8.Idaho Governing Law and Venue. This Agreement shall be governed by the laws of the State of Idaho. Any legal action arising out of or related to this Agreement or the Activities shall be brought exclusively in the state courts located in Ada County, Idaho, and the parties consent to such jurisdiction and venue. 9.Severability. If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. 10.Electronic Signature. This Agreement may be executed electronically, and any electronic signature shall be deemed to have the same legal effect as an original handwritten signature. I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT OR COERCION.
